On Jan. 5 he notified President Roosevelt that he would retire on Jan. 18, after fifteen years of active service on the bench. Since the inauguration of the President, the 75-year-old Justice has been one of the most consistent opponents of administration legislation on the bench. He was one of a group of four Justices generally described as conservative. His retirement gives president Roosevelt his second opportunity to make an appointment to the Supreme Court.T-1/5/38 (s) FILE.
