In his 1954 Charles Cahan case, the California Supreme Court ruled that evidence illegally obtained cannot be used against a defendent. EMILE ZOLA BERMAN, 65, of New York City, Berman is best known for his defense of a Marine sergeant accused on a night march into a swamp where six died. The sergeant was convicted of negligent homicide.
